The terms that apply when you use our website or work with Mick Web Agency.
Last updated: 3 November 2026
Mick Web Agency is the trade name of Mick Graphics and Web Design, Business No. BN-RPCM7DEG (“we”, “us”, “our”). These terms apply when you use our website or engage us for our services. By engaging us, you agree to these terms, so please read them carefully. If a signed contract or written agreement with us says something different, that agreement takes priority.
We provide website design and development, website management and SEO, Google Ads consultations, app development, API integration and web hosting. The scope of work, deliverables and timelines for each project will be discussed and agreed in writing before work begins. Timelines are estimates, and they depend on the project and on receiving your content and feedback on time.
To begin a project, we require a 50% upfront payment, with the remaining 50% due on completion and before launch.
Invoices must be paid within 7 days of the invoice date unless otherwise agreed in writing. Any late payment terms are agreed individually with each client.
If invoices are not paid as set out in these terms, we may suspend or end our services, and we may take legal action to recover unpaid amounts.
Deposits are non-refundable. This includes the 50% upfront payment made at the start of a project.
You are responsible for providing the content, images and information we need, and for making sure you have the right to use them. You agree that the materials you give us do not break any law or infringe anyone else’s rights. You are also responsible for checking the accuracy of your content before launch.
When we share your website for review, please give your feedback in good time. If we do not receive feedback within a reasonable period, we may issue the final project invoice, which will be due in full within 7 days of receipt.
Website management is billed on a recurring basis according to the agreed schedule, and recurring management fees are non-refundable. Any hourly work and additional hours are agreed individually with each client. Management billing continues until the website is transferred to your server or launched on ours, or until the service is ended.
Websites and apps often rely on third-party services such as hosting providers, domain registrars, payment gateways, plugins and app stores. These services have their own terms and may change or become unavailable, and we are not responsible for their performance. Domain names should be registered in your name, so that they remain under your control.
We do not guarantee any particular search engine ranking, advertising result, traffic level or sales figure. These depend on many factors outside our control, including your market, competitors and budget.
Once final payment has been received, ownership of the website we created for you transfers to you, excluding any third-party software, plugins, themes or licensed materials, which remain subject to their own licences. We may show the project in our portfolio unless otherwise agreed in writing.
To the extent permitted by law, we are not liable for indirect, incidental or consequential losses arising from the use of, or inability to use, our website or services. This includes downtime, data loss, or issues caused by non-payment, project delays or third-party services. To the extent permitted by law, our total liability for any claim is limited to the amount you paid us for the service concerned.
Either party may end an agreement at any time by written notice. Any work completed up to that point must be paid for in full. If you end a project after making the upfront payment, the deposit remains non-refundable.
The content on our website is for general information and belongs to us or our licensors, including client logos and work shown with permission. You may not copy or reuse it for commercial purposes without our permission, or use the website in a way that harms it or other users.
These terms are governed by the laws of Kenya, and any disputes are subject to the jurisdiction of the Courts of Kenya.
We may update these terms from time to time. Changes will be posted on this page, and the updated terms apply to work and use of our website after that date. Existing written agreements continue under their own terms.
